A trust service provider is an organization that is officially authorized to issue, for example, digital certificates and digital timestamps. Both the EU and Switzerland maintain lists of recognized trust service providers, which naturally includes Swisscom.

Swisscom is the only European provider that meets both the legal requirements for e-signatures of the EU (the eIDAS Regulation) and the legal requirements of Switzerland (the ZertES).

Identification for the QES via Swisscom

The qualified electronic signature (QES) is the highest of the three e-signature standards. It is legally equivalent to a handwritten signature and is even valid for those documents that must comply with written form requirements.

To sign with QES, you need to identify yourself once with an identification document (passport or ID card). This identification for the qualified electronic signature is quickly completed thanks to Swisscom.

You have the following options:

  • Video Identification: A live video call will take place with an employee from Swisscom.
  • Self-Identification: You identify yourself independently by taking a photo of your ID and recording a video of yourself.
  • Personal Identification in a Swisscom store: You appear in person at a Swisscom store in Switzerland.
  • Personal identification through an in-house procedure: Trained employees of your company take on the identification of colleagues.

If you wish to sign legally with the advanced or qualified electronic signature, you must identify yourself beforehand. The type of identification depends on the e-signature standard: for the advanced electronic signature, a mobile phone number is sufficient for identification. For the qualified electronic signature, you must identify yourself with an identification document – either online or in person on-site.

Identification for a qualified electronic signature with Swisscom is possible through various methods. The most popular include: identification via video call, self-identification via app, or personal identification on-site.

A trust service provider is an organization that offers electronic services to make digital transactions more secure and trustworthy. The goal is to ensure the integrity, authenticity, and confidentiality of documents and transactions. For this purpose, trust service providers offer, for example, digital certificates, timestamps, and electronic seals.

Yes, according to Swiss law (ZertES), electronic signatures are valid – however, it depends on the e-signature standard and the signed document in each individual case. Documents that require written form can only be legally electronically signed with a qualified electronic signature that meets the requirements of ZertES. Electronic signatures under eIDAS are not automatically valid in Switzerland, but are generally recognized by the courts.

A Swiss QES is not automatically legally valid in the EU, as there is no agreement between Switzerland and the EU to recognize each other's e-signatures. However, in the event of a dispute, it is likely that a court would rule in favor of the validity of the QES, as the requirements for a Swiss QES (according to ZertES) and a QES of the EU (according to eIDAS) are nearly identical.
